Membership Sign-Up

The buyer represents that the member (buyer and member may be the same person) is covered under the buyer’s insurance policies to cover any personal injuries to them personally or which they may cause to others. The buyer and member agree to deal directly with the buyer’s carrier and not the gym on any claim. The buyer acknowledges that the membership cost reflects the savings because the Buyer and Member provide their insurance and not the Gym. ANY PERSON USING THE EQUIPMENT OR THE FACULTY DOES SO AT THEIR OWN RISK. It is further agreed that all exercises, including weights, number of repetitions, and use of any machinery, equipment, and apparatus designed, or exercising shall be at the Buyers and Member’s sole risk. Notwithstanding any consultation on exercise programs that may be provided by Gym employees, it is hereby understood that the selections of exercise programs, methods, and types of equipment shall be the Buyer or Member’s entire responsibility, and the Gym shall not be liable to Buyer or Member or any claims, demands, injuries, damages, or actions arising due to injury to Buyer or Member, their person, or property arising out of or in connection with the use by Buyer or Member of the services and facilities or the premises where the same is located and Buyer or Member hereby holds the Gym, its contractors and agents harmless from all claims which may be brought against them by Buyer or Member or on either of their behalf for such injuries or claims aforesaid. Buyer and Member shall also examine each piece of equipment before use and refrain from use and report the same if there is any indication that the equipment has been subjected to abuse, damaged, or is in an unsafe or potentially dangerous condition. Buyers and members have a duty to exercise care for the protection of themselves and other members while using the premises. If an accident is caused by a defect or faulty design of the equipment, the injured party will direct any claim against the manufacturer, holding the LLC harmless and subrogating their rights, if any, to the LLC. Buyer and Member, if injured, or Member’s representative if Member is unable to do so, must complete, sign and deliver an incident report within seventy-two (72) hours of the time of occurrence. As to overexertion, stresses, and Member’s physical condition, and any other concerns, or that the Buyer or Member will seek such advice, or that buyer or Member assumes the risk of proceeding without such advice. Buyer and Member represent that they have read and agree to abide by the rules and regulations of the gym. Buyer and Member agree to report any violation of the rules and regulations; Buyer and Member recognize that Gym employees cannot monitor every Gym user for a violation of the rules.

I have been instructed and agree to use the required SAFETY BARS and/or have a spotter during any weightlifting or exercise sessions.

) I acknowledge that this is an UNSUPERVISED FITNESS CENTER and I assume all risks associated with using exercise equipment and exercising alone without the aid and presence of CLUB staff on the premises. ***“All equipment, classes, and times are subject to change or deletion at the discretion of the facility.”***
Gym shall not be liable to Buyer or Member for any claims, demands, or actions arising due to breach of the Gym rules by other Gym members or users or any conduct of Gym members or users. Failure of Buyer and Member to comply with this contract or any rule or regulation shall be cause for revocation of membership without notice and any liability or refund.
Memberships – Open hours are at the sole discretion of the LLC. Failure to pay or delayed payment may result in the loss of your membership. The gym closed Sunday.

Replacement of access key & re-activation is a $34.99 charge. No key Refunds. Members are required to replace the access key upon having 3+ occurrences of signing in the “Missing Key” list. All members must wear shirts, shoes, and socks, (No Sandals). Memberships may be transferred to a non-Alpine Fitness gym member at any time with a $99 fee.

Unauthorized use of your access key, tailgating, or entry other than the front (East) door will result in a charge of $49 per occurrence to your account.

Lockers are provided as a courtesy for hour use only without guarantee. There are no locks on the lockers. All personal belongings must be placed in lockers and not left on the floor. The LLC IS NOT RESPONSIBLE FOR LOST, STOLEN, OR DAMAGED ARTICLES; DO NOT BRING VALUABLES TO THE PREMISES.

Adult – All buyers/members that sign the membership agreement, assumption of risk, and rules and regulations shall be assumed to be 18 years of age or older. By signing any of these categories, I incorporate the responsibility of proof of legal age.

Minor-Legal guardian must sign for approval of minor’s membership agreement. A minor that is 16 – 17 years of age, does not require adult supervision. A minor 12-15 years of age must always be accompanied by the instructor.
Violation – Failure by a member to comply with this contract or any rule or regulation shall be cause for the revocation of membership without any notice and liability for refund.

In consideration to Buyer for a waiver by a buyer of legal rights and acceptance of full release and all other provisions under this agreement, ALPINE FITNESS, DBA agrees to reduce the processing fee from $99 to $0. I understand by agreeing I am waiving my right to use the gym’s insurance for the damage caused to the gym facility, equipment, and myself. Furthermore, I agree to take full financial responsibility to cover any cost of damage to myself, the gym facility (floors, mirrors, walls, (i.e.. dropping weights), and abuse/misuse of facility equipment.

(BI-MONTHLY) PAYMENTS of $ 41.99 ARE DUE ON THE 1st & 16th OF EACH MONTH BEGINNING {today}
EFT Requests: Buyer (individually and as agent or guardian of Client) hereby authorizes ALPINE FITNESS, LLC or its assigns to make periodic charges or withdrawals (“EFT Authorization”) from the account used to pay the initial payment describes above or the account listed below or replacement account designated by Buyer and accepted by ALPINE FITNESS, LLC, for payment of any fees, late charges, costs, expenses or any other monies due to ALPINE FITNESS, LLC under the terms and conditions of this agreement. Buyer understands that Buyer is entitled to notice of all varying charges and withdrawals under the EFT, but Buyer waives the right to receive prior notice for charges or withdrawals made concerning any uncollected payments or portions of the balance due described above and the corresponding services charges, both of which Buyer agrees are not varying charges or withdrawals. Buyer may change the account designated herein upon thirty-one (31) days of written notice to, and approval by, ALPINE FITNESS, LLC. Buyer may timely notify the financial institution in control of Buyer’s account to terminate this Request, but such notification will constitute a default and may cause all sums under this Agreement to be due and payable immediately together with all costs of collection to the extent permitted by law.
ALPINE FITNESS, LLC or its assigns reserve the right to charge a $25 fee if an EFT draft is declined or if a check is returned. ALPINE FITNESS, LLC or its assigns reserves the right to terminate this agreement if an EFT draft is declined or a check is returned.

I understand that unless I submit a notice of written cancellation at least 31 days before the next scheduled E.F.T. payment as described in the “Payment Schedule” section above, this contract will automatically convert to a month-to-month agreement, whereby I will continue to purchase a monthly membership based upon the ‘bi-monthly’ membership price of $41.99. I understand that this contract is non-cancelable during the term set for in this contract or in the middle of a month. I have read the foregoing Assumption of Risk Clause and understand and agree. I further agree that by signing below I incorporate personal responsibility for all contract terms financial and otherwise contained in the contract as a whole and agree to the terms on page #2.

By signing below, I agree to pay all amount(s) owed within 30 days of when such amount(s) are incurred. I understand that it is my responsibility to provide correct/updated information. However, I agree that it is and shall remain my responsibility to pay all amounts owing as set forth herein. I agree that interest will accrue on all past-due amounts at the rate of 18% per annum (1.5% per month) until paid in full. In the event any amount(s) is/are referred to a third-party debt collection agency, I agree that in addition to any other amount(s) allow for by law, (such as interest, court costs, reasonable attorney’s fees, etc.) I will also be responsible for a collection fee of up to 40% of the principal amount(s) owing as allowed by Utah Code Annotated, sec. 12-1-11. The terms of the paragraph shall apply to all amount(s) incurred by me or by any individual for whom I have legal responsibility whether such amount(s) are incurred today or after today.
I hereby consent to be contacted by telephone at any telephone number (including but not limited to wireless/cellular phone numbers) provided by me or anyone associated with me or acting on my behalf to Alpine Fitness or anyone acting on its behalf. I understand and agree that such calls may be initiated by Alpine Fitness or any of its affiliates, agents, contractors, or assigns, including but not limited to billing companies and/or third-party collection agency(ies), and that the methods of contact may include using prerecorded/artificial voice messages and/or the use of an automated dialing device and/or the use of text messages—some or all of which may result in data charges. I also consent to receiving emails at any email address provided by me or anyone associated with me or acting on my behalf.
